RENTAL AGREEMENT – TERMS AND CONDITIONS
Definitions:
a)	Vehicle: The car, camper, or van provided under this Agreement, including its standard components (engine, drivetrain, bodywork, tires, windows, battery), and any integrated features such as heating, lighting, or infotainment systems. This also includes any Accessories or Extras rented or included with the Vehicle.
b)	Renter or Lessee: The person or legal entity responsible for the rented Vehicle and contractually bound by the terms of this Agreement.
c)	KONVIN or Lessor: KONVIN Car Rental ehf., the provider of the rental Vehicle, including vehicles rented under affiliated brands or franchises such as Carwiz or Volcano Car Rental. All such rentals are governed by this Agreement, regardless of the brand under which the booking was made or the agency or commission-based partner through which the rental was arranged.
d)	Agreement or Rental Agreement: This rental contract between KONVIN Car Rental ehf. and the Renter, including all referenced documents and annexes.
e)	Driver or Additional Driver: Any individual listed on the Rental Agreement as authorized to operate the Vehicle, including the Renter or Lessee
f)	Insurance Package: A bundle of coverages provided by KONVIN (e.g., SCDW, GP, TP, SAAP, Theft Protection) 
g)	Self-Excess or Excess: The portion of the cost that remains the Renter’s responsibility in the event of an insurable incident, as defined by the applicable insurance coverage and package selected.
h)	Deposit: The credit card hold amount required at pickup.
i)	F-Roads: Highland/Mountain roads in Iceland marked with an “F” on official maps and only accessible by pre-approved 4x4 vehicles.
j)	Accessories or Extras: All items included or rented with the Vehicle (e.g., roof box, roof top tent, GPS, utensils, keys).
k)	Third-party Charges/Penalties: Any fines, fees, or penalties imposed by public authorities or private parties in connection with the use of the Vehicle during the Rental Period. This includes, but is not limited to, parking fines, road tolls, traffic violations and charges for entering or driving in restricted areas.

1.	Driver Eligibility and Age Restrictions
1.1.	To rent a Vehicle from KONVIN, all drivers must be at least 18 years old and must hold and duly present a valid physical driver’s license issued at least 12 months prior to the start of the Rental Period. If the Lessee or any listed Additional Driver is under the age of 20, a separate Insurance Package must be purchased before the rental begins (see Section 8. Insurance policy). KONVIN reserves the right to cancel the rental without a refund if these requirements are not met.

2.	Credit Card Policy, Security Deposit and Authorization
2.1.	A valid credit card is required for every rental. At pick-up, KONVIN will place a pre-authorization hold of up to ISK 350,000 on the card as a security Deposit. The amount depends on the selected insurance package (see Insurance Policies).
2.2.	The pre-authorized amount may be used to cover unpaid charges under this Agreement, including but not limited to vehicle upgrades, late returns, damage or costs not covered by insurance, missing fuel, Third-party Charges/Penalties, or misuse of the Vehicle.
2.3.	KONVIN also requires a credit card imprint, which may be used to recover outstanding costs and claims if the pre-authorized amount is insufficient or if no pre-authorization was taken due to an insurance package selected.
2.4.	The Renter remains liable for all amounts not covered by insurance. These may be charged to the card on file without further notice.
2.5.	If a third party provides the credit card for the Deposit, they agree to be charged for any amounts owed under this Agreement to the extent that the Renter or any listed Driver is liable. This does not release the Renter from their obligations under this agreement.
2.6.	Cash, prepaid cards, debit cards, and electronic wallets (e.g., Apple Pay, Google Pay) are not accepted for Deposit or imprint purposes.
2.7.	The Renter acknowledges that any waiver of pre-authorization does not waive their financial liability under this Agreement, which may then be recovered through imprint or post-rental charges.
3.	Fuel policy, service fees and penalties
3.1.	The Vehicle is provided with a full tank of fuel unless otherwise agreed in writing and must be returned with a full tank at the end of the Rental Period. If the Vehicle is returned with less than a full tank, the Renter will be charged for the missing fuel plus a refueling service fee of ISK 5,000. The Renter is responsible for all operational costs during the Rental Period, including fuel, fluids, tolls, and any consumables necessary to operate the Vehicle safely.
3.2.	The Renter is responsible for any tire damage and the costs and changing of damaged tires during the Rental Period, unless otherwise stated in selected Insurance Package.
3.3.	Smoking is not allowed in any Vehicle. A cleaning and penalty fee of ISK 35,000 will be charged if smoking is detected in the Vehicle.
3.4.	The Renter is responsible for all Third-party Charges/Penalties during the Rental Period. If KONVIN is charged for any Third-party Charges/Penalties, all such charges will be re-charged to the Renter, along with an administrative fee of ISK 5,000.
3.5.	An administration fee of ISK 5,000 applies when KONVIN is required to provide the Driver´s, personal details to Icelandic authorities in connection with traffic violations.
3.6.	If the Vehicle is returned with an excessively dirty interior an extra cleaning fee of ISK 30,000 will be charged.
3.7.	Towing is not included in any insurance coverage. If towing is required due to Renter fault or misuse — and the cause is not related to normal wear and tear or attributable to KONVIN — a fee of ISK 450 per kilometer applies. Distance is calculated from and back to KONVIN’s main office, regardless of pickup or breakdown location. A minimum towing charge of ISK 40,000 applies if the calculated distance-based fee is lower than this amount.
4.	Obligations of the Lessee
4.1.	The Renter confirms acceptance of this Agreement and acknowledges having received a copy of it.
4.2.	The Vehicle must be returned;
•	With all Accessories and Extras delivered with the vehicle at the start of the rental (including tires, tools, and repair kits) in the same condition as received, except for normal wear and tear.
•	With the interior—including seats, mattress, kitchen appliances, and interior fittings - in clean and undamaged condition.
•	On the agreed return date, unless otherwise arranged in writing.
•	To KONVIN’s rental location, unless otherwise agreed.
•	Reasonably clean. If additional cleaning is required, an additional cleaning fee of ISK 20,000 will apply.
•	With all trash, food and personal belongings removed from the Vehicle.
•	With any rented Accessories or Extra equipment returned packed and in proper order.
•	Exterior cleaning is not required by the Renter.
4.3.	The Vehicle must be handled and driven with care, caution and in accordance with Icelandic laws. Only Drivers listed in the Rental Agreement are authorized to operate the Vehicle. The Renter is fully liable for any damage or injury not covered by insurance, including -but not limited to - cases involving:
•	Off-road driving, including on trails, beaches, riverbeds, or other non-designated roads or paths
•	Driving through rivers or water crossings
•	Intentional damage or gross negligence
•	Driving under the influence of alcohol, drugs, or intoxicants
•	Violations of Icelandic law or the terms of this Agreement
•	Driving in deep snow, on ice banks, or during extreme weather conditions such as strong winds
•	Damage to the roof, roof-mounted equipment, or roof box due to improper use or overloading
4.4.	Driving on F-roads or highland routes — including Kjölur (Road 35), Dettifoss east side (Road 864), Kaldidalur (Road 550), and Jökulshálsleið (Road 570) - is strictly prohibited unless using a 4x4 vehicle explicitly approved by KONVIN for such use. Driving on roads or tracks without a designated road number is also forbidden. Breach of this clause may result in a fine equal to the applicable insurance excess, in addition to full liability for any damage, costs, or claims. This includes fines, penalties, or environmental charges imposed on KONVIN or the Renter by public authorities due to unlawful or unauthorized vehicle use. The Renter is solely responsible for monitoring road conditions, weather forecasts, and official travel warnings throughout the Rental Period. Travel in adverse or extreme weather conditions is undertaken at the Renter’s own risk.
4.5.	In the event of an accident or collision, the Renter must immediately notify the police (call 112) and KONVIN. The Renter may not leave the scene until the police have arrived, unless it is necessary to seek medical assistance or to prevent a personal safety hazard.
4.6.	The Renter is strictly prohibited from using the vehicle for paid passenger transport, subleasing it, or lending it to any person not listed in the Rental Agreement.
4.7.	The Renter is strictly prohibited from carrying out or authorizing any repairs, modifications, or alterations to the vehicle or its Accessories and Extras without prior written consent from KONVIN. The vehicle may not be pledged, used as security, or subjected to any encumbrance under any circumstances.
4.8.	If the Vehicle is not returned at the agreed time, KONVIN may reclaim it - directly or with the assistance of third-party services or the authorities - at the Renter’s expense.
4.9.	Additional fees may apply for each day or part-day the Vehicle is retained beyond the agreed return time. All rental extensions must be pre-approved by KONVIN and are charged separately from the original rental amount.
4.10.	The Rental Period, including the Renter’s liability for the Vehicle, remains active until KONVIN has confirmed the return by registering the Vehicle in its system. This registration can only be completed during office hours. Any damage, costs, or usage recorded prior to this confirmation remains the responsibility of the Renter.
4.11.	If the Vehicle is returned before the scheduled return time, KONVIN does not refund unused rental days. Early returns do not entitle the Renter to partial refunds, credits, or compensation unless otherwise agreed in writing.
5.	Obligations of KONVIN
5.1.	KONVIN is responsible for delivering the Vehicle at the agreed time and in a condition that complies with the Rental Agreement and Icelandic laws.
5.2.	If the Vehicle becomes undrivable due to mechanical failure caused by normal wear and tear or other reasons not reasonably attributable to the Renter, KONVIN will either provide a comparable replacement vehicle within 24 hours or arrange for necessary repairs. KONVIN does not cover accommodation costs or other incidental expenses resulting from such incidents.
5.3.	KONVIN will inform foreign Renters of relevant Icelandic traffic laws, road signage, the ban on off-road driving, and the potential dangers posed by livestock or wild animals on the roads.
5.4.	If KONVIN imposes restrictions on the use of the vehicle - such as limitations based on equipment or road conditions - these must be stated in writing at the time of signing the Rental Agreement.
5.5.	KONVIN maintains valid liability insurance for its operations.
5.6.	KONVIN is not responsible for any personal belongings during the Rental Period, or which are left in the vehicle after it has been returned.
5.7.	KONVIN will duly present these terms and conditions to the customer, which the customer accepts by signing.
6.	Insurance Policies
6.1.	All rentals with KONVIN include basic insurance coverage, including:
6.1.1.	Third-party liability and personal accident insurance in accordance with Icelandic law. This applies to both property damage and bodily injury caused to others, as well as to the personal liability of the listed driver.
6.1.2.	Collision Damage Waiver (CDW) is included. The standard self-excess is ISK 350,000 unless reduced by an insurance package.
6.1.3.	Third part liability (TPL) is included. The standard self-excess is ISK 35,000 unless reduced by an insurance package.
6.1.4.	Gravel Protection (GP) covers the vehicle against damages to the windscreen, paint on bumpers, hood and doors caused by gravel shotting from passing vehicle. Standard self-excess is ISK 200,000.
6.1.5.	Sand and Ash Protection (SAAP) covers damage caused by volcanic ash or sandstorms. Standard excess is up to ISK 2,000,000.
6.1.6.	Tire Protection (TP) covers punctures and flat tires. TP is not included by default and carries full liability unless the Renter has purchased a protection package.
6.1.7.	Theft Protection is included in all rentals and covers the vehicle in case of theft. It does not extend to personal belongings inside the vehicle. Self-excess for theft-protection in ISK 350,000.
6.1.8.	In the event of a collision or damage where the Renter or Driver is not at fault, but the responsible party cannot be identified or held liable (e.g., in the case of a hit-and-run or unknown damage), the Renter remains liable for the damage to the rental vehicle in accordance with this Agreement and the applicable insurance terms.
6.2.	KONVIN offers enhanced insurance packages that reduce or eliminate the Renter's liability for insurance incidents:
6.2.1.	Gold Package
	Includes CDW, Super Collision Damage Waiver (SCDW), GP, SAAP, and Theft Protection.
6.2.2.	CDW is upgraded to SCDW, reducing the excess from ISK 350,000 to ISK 50,000.
6.2.3.	SAAP excess is reduced to ISK 50,000.
6.2.4.	TP excess is reduced to ISK 120,000.
6.2.5.	GP and Theft Protetion are fully covered with 0 ISK excess.
6.2.6.	Credit-Card pre-authorization may be reduced to ISK 50,000.
6.2.7.	Platinum Package
Includes all coverage in the Gold Package with full elimination of Self-excess in insurable events.
•	CDW is upgraded to SCDW with 0 ISK Self-excess.
•	All damage types including SAAP, TP, GP and Theft Protection are covered with 0 ISK excess.
•	Credit-Card pre-authorization may be reduced to ISK 0.

Important: Insurance packages (including Gold and Platinum) do not cover additional service fees or penalties. These include, but are not limited to: cleaning charges, towing fees resulting from renter misuse or negligence, administrative fees, traffic fines, or any costs arising from a breach of the Rental Agreement.


6.3.	Off-Road or Unauthorized Use
•	Damage resulting from off-road driving, river crossings, or driving in unauthorized areas is not covered by any insurance. This includes damage to the interior, exterior, undercarriage, chassis, mechanical or electrical systems, or engine components. In such cases, the Renter is fully liable for the full cost of repairs or the total replacement value of the vehicle, as determined by KONVIN.
•	If the vehicle is operated by a person not listed as an authorized Driver in the Rental Agreement, all insurance coverage becomes void. In such cases, the Renter assumes full liability for any damage to the Vehicle, damage caused to third parties, property, or other vehicles, and is obligated to cover all related costs in full. 
6.4.	Insurance exclusions – What Insurance Does Not Cover
The Renter is fully liable for all damage and costs resulting from or directly linked to the following, regardless of any purchased insurance packages:
•	Intentional damage or gross negligence
•	Driving under the influence of alcohol, drugs, sedatives or any intoxicants
•	Racing, reckless behavior, or test driving
•	Driving on beaches, in rivers, on snowbanks, on unbridged trails or roads not marked for vehicular use
•	Damage from natural disasters, volcanic eruptions, war, riots, or civil unrest
•	Burned, ripped, or soiled seats, carpets, or interior materials
•	Any breach of Section 4 (Obligations of the Renter)
•	Damage to the tires, undercarriage, or chassis from reckless driving, uneven terrain or river-crossings
•	Water damage caused by driving in rivers, lakes, or the sea
•	Refueling with the wrong fuel type
•	Damage to the roof of the Vehicle from misuse, overloading, or climbing
•	Damage caused by, or because of animals
•	Damage resulting from the Vehicle being driven by anyone not listed as a Driver in the Rental Agreement
•	Loss or damage to Accessories or Extras, including but not limited to keys, Wi-Fi hotspots, GPS units, kitchen equipment, sleeping bags, chairs, tables, roof boxes, or roof tents
•	Loss or damage to personal belongings of the Renter or any passengers of the Vehicle.
7.	Disruptions, Delays, and Force Majeure
7.1.	KONVIN is not liable for delays or failures resulting from events beyond its reasonable control, including but not limited to volcanic eruptions, natural disasters, extreme weather, strikes, war, pandemics, or disruptions in essential services. This also applies to missed pickups due to third-party travel issues, such as delayed flights or transfers, provided such delays are not caused by KONVIN. In such cases, KONVIN will make reasonable efforts to assist the Renter and accommodate their needs, but is under no obligation to provide alternative transport, compensation, or a refund.
8.	General Provisions
8.1.	Cancellations made more than 24 hours prior to the scheduled pick-up time are fully refundable. No refunds will be provided for cancellations made within 24 hours of the scheduled pick-up.
8.2.	KONVIN reserves the right to cancel the rental without refund if the Renter fails to meet the Driver eligibility requirements or breaches any terms of this Agreement, including but not limited to payment obligations, prohibited use, insurance conditions, or return requirements.
8.3.	A copy of this Rental Agreement must be kept in the Vehicle for the duration of the Rental Period.
8.4.	Any amendments or addenda to this Agreement must be made in writing and approved by both parties.
8.5.	KONVIN reserves the right to debit the Renter’s credit or bank card for any amounts due under this Agreement, including but not limited to rental fees, damages, penalties, and Third-party Charges/Penalties. This may be done in a single lump sum or in multiple transactions at KONVIN´s sole discretion. This right remains valid for up to six (6) months following the return of the Vehicle.
8.6.	If compensation claims are made against the Renter (e.g., for unpaid charges or damages), KONVIN may apply a minimum surcharge of 20% of the claimed amount to cover collection and legal costs.
8.7.	KONVIN processes personal data in accordance with the GDPR, Icelandic privacy laws, and other applicable regulations. By entering this Agreement, the Renter consents to the collection and use of personal data (e.g. name, ID, contact, payment details) for contractual, legal, and service-related purposes. Data may be shared with third parties when necessary for operations or compliance. The Renter may request access, correction, restriction, or deletion of their data.
8.8.	This Agreement is governed by Icelandic law. If a dispute arises, the parties shall first attempt to resolve it through mutual negotiation. If unresolved, the dispute may be referred to the Arbitration Committee of the Icelandic Consumers Association and the Icelandic Travel Industry Association.
8.9.	If arbitration is not pursued or fails to resolve the matter, legal proceedings shall take place before the District Court of Reykjanes (Héraðsdómur Reykjaness). This does not affect any consumer rights under mandatory law.
8.10.	By confirming a booking through KONVIN or any affiliated platform, the Renter accepts the terms of this Agreement. By signing at Vehicle pickup, the Renter also confirms receipt of the Vehicle and any included Accessories or Extras in acceptable condition and acknowledges having reported any discrepancies to KONVIN staff and expressly authorizes KONVIN to charge their credit or bank card for any amounts owed under this Agreement without requiring further approval or additional signatures.
